Terms of Use

By creating an account or using MightyMaps you agree to these terms. If you do not agree, do not use the service.

1. What the service is

MightyMaps is a web application that builds interactive maps from your instructions using an AI assistant. It lets you create maps, refine them by chatting, publish them at a public link, and buy credits that pay for the AI work.

2. Accounts

You must be at least 13 to use MightyMaps, and if you are under the age of majority where you live, only with the consent of a parent or guardian who accepts these terms. You agree to give accurate registration details, keep access to your account secure, and take responsibility for everything done under it.

3. Credits and billing

• MightyMaps has no subscription. You buy credits in prepaid packs, or use the 25 credits granted once when you create an account.
• Credits are consumed when you send a message to the AI assistant. The amount depends on the work that message required, so it varies between messages.
• Viewing, publishing, sharing or deleting a map does not consume credits.
• Credits do not expire, and there is no monthly reset.
• Payments are processed by Stripe, which acts as merchant of record for credit purchases and handles applicable taxes.
• Purchases are generally final. Credits are a digital product delivered immediately; if something has gone wrong, contact us and we will deal with it fairly.
• We may change credit prices, pack sizes or how much a given action costs. Changes apply to future purchases and future usage, not retroactively to credits already in your balance.
• When your balance reaches zero, your existing maps and published links keep working. You simply cannot ask the assistant for further changes until you top up.

4. AI-generated content

Maps are generated by an AI model. That has consequences you need to accept before relying on one:

• It can be wrong. Coordinates, routes, distances, addresses, opening hours, prices, tide and transport times and any other fact on a generated map may be inaccurate, out of date or invented.
• You are responsible for checking it. Review a map before relying on it or sharing it, particularly anything that affects travel, safety or money.
• It is not navigation. Do not use a MightyMaps map for turn-by-turn navigation, marine or aviation navigation, emergency routing, or any situation where an error could cause harm. Routes are illustrative. Carry a proper map for backcountry travel.
• It is not professional advice of any kind — not legal, medical, financial, safety or compliance advice.
• Intellectual property in AI output is unsettled and varies by country. We make no representation that AI-generated content is protectable, exclusive to you, or free of third-party rights.

5. Your content

You keep all rights to the content you put into MightyMaps. You grant us a non-exclusive, worldwide, royalty-free licence to store, process, display and transmit it for the purpose of operating the service — including sending it to our AI provider to answer your requests, serving it as a public page when you publish a map, and accessing it to provide support, investigate abuse or comply with the law.

You are responsible for having the right to use whatever you put on a map, including text you paste in from elsewhere.

We may remove or restrict content that we believe breaches these terms or the law, but we have no obligation to monitor content and we do not endorse it.

6. Public maps

A map you publish is readable by anyone with its link. You are responsible for what you put on it, including any personal information about other people — guests, staff, customers — and for having a basis to publish it. Published pages carry a small "Made with MightyMaps" credit, which you may not remove. Switching a map back to private takes the page down.

7. Acceptable use

You agree not to use MightyMaps to:

• break the law, or infringe anyone's rights;
• publish content that is illegal, harassing, hateful, deceptive or invasive of privacy;
• track or surveil people without their knowledge;
• publish someone's home address or other personal information to expose or harass them;
• plan or facilitate violence, or map targets for it;
• attack, probe or overload the service, or try to reach data that is not yours;
• automate the assistant at scale, resell access, or use the service to build a competing map generator;
• circumvent credit metering or usage limits.

We may suspend or terminate an account that does any of this, without notice.

8. Availability

There is no uptime guarantee. MightyMaps is provided on a best-effort basis. It may be slow, unavailable, changed or discontinued. Published maps may be temporarily unreachable. Do not use it as critical infrastructure, and keep your own copy of anything you cannot afford to lose. We may modify or withdraw features at any time.

9. Termination

You can stop using MightyMaps at any time, and you can ask us to delete your account by emailing support@mightymaps.app. We may suspend or close an account that breaches these terms, is used fraudulently, or where we are required to by law. On termination, your right to use the service ends, published maps stop being served, and unused credits are forfeited and not refunded. Ask us for an export before you delete anything you want to keep.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING ANY RELIANCE ON AI-GENERATED CONTENT.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Nothing here excludes liability that cannot be excluded under the law that applies to you.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising from your use of the service, the content you create or publish with it, your breach of these terms, or your infringement of anyone else's rights.

13. Governing law and disputes

These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there. Before starting any formal proceeding, you agree to email support@mightymaps.app and try to resolve the matter informally for at least 30 days. If that fails, the courts of Saskatchewan have exclusive jurisdiction. Disputes are handled individually — you agree not to bring a class or representative action.

14. Changes to these terms

We may update these terms. Material changes will be announced by email or in the app, and the "last updated" date above will change. Continuing to use MightyMaps after that means you accept the new terms.

15. Miscellaneous

If any provision is found unenforceable, it is limited or severed and the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between us about the service.
