Terms of Use
1. Your agreement with us
These terms are a binding agreement between you and MightyMaps (we, us), which operates this website and the service at dashboard.mightymaps.app and map.mightymaps.app (the Service). By creating an account, buying credits, or otherwise using the Service, you agree to these terms, to our Privacy Policy, and to the credit details shown on our pricing page and at checkout at the time of purchase, which form part of this agreement. If you do not agree, do not use the Service.
You must be at least 13 to use the Service, and if you are under the age of majority where you live, only with the consent of a parent or guardian who accepts these terms for you. If you use the Service for a company or other organisation, you confirm that you have authority to bind it, and you then means both you and that organisation.
2. Your account
Give us accurate information, keep it current, and keep your sign-in methods secure. You are responsible for everything that happens under your account, including changes the AI makes at your request. Tell us promptly at support@mightymaps.app if you believe somebody else has access to your account.
3. Your content
Your Content means the text, places, notes, prompts and other material you submit to the Service, and the maps and other output generated for you from it. You are solely responsible for Your Content and for having every right and permission needed to submit, generate, publish and use it, including text you paste in from elsewhere and information about other people.
As between you and us, you keep your rights in Your Content and, to the extent the law permits, own the output generated for you. Output may not be unique or protectable, other people may receive similar output, and we do not promise that any output is free of other people's rights.
You grant us a worldwide, non-exclusive, royalty-free, transferable licence, with the right to sublicense to our service providers, to host, store, copy, process, transmit, display, adapt and publish Your Content as needed to provide, maintain, secure, support and improve the Service, to enforce these terms, and to comply with law. You also allow us to show your public maps, their titles and screenshots of them as examples of what the Service can do; you can ask us to stop at any time. The licence continues for as long as we hold the content, including in backups and records we keep under the Privacy Policy.
If you send us ideas, suggestions or feedback, we may use them for any purpose without obligation to you.
4. AI output, and maps are not navigation
Maps are generated by AI. AI output can be inaccurate, incomplete, out of date, invented or unsuitable: coordinates, routes, distances, addresses, opening hours, prices, transport and tide times, and every other fact on a map may be wrong. It may misunderstand an instruction or change something you did not ask it to. It is not legal, medical, financial, safety or other professional advice. You must review a map, and check anything important, before you publish it, share it or rely on it.
A MightyMaps map is not a navigation tool. Routes and positions are illustrative. Do not use the Service for turn-by-turn, marine, aviation or backcountry navigation, emergency routing, or any situation where an error could cause injury, loss or damage. You take on the risk of publishing or relying on output.
Credits pay for the work done, not for a particular result. A request uses credits for the work it took whether or not the result is what you wanted, and a request that stops early or has to be repeated may still use credits. We may change the models and providers the Service uses at any time, which can change both output and the credits a request uses.
5. Public maps
Maps are private until you make them public. A public map can be seen by anyone with its link, and can be copied, forwarded or indexed like any other web page. You are responsible for your public maps and for everything on them, including personal information about other people and having a lawful basis to publish it. Public maps carry a "Made with MightyMaps" credit and the attributions of the map data they use, which you must not remove, hide or obscure.
Unless we have agreed otherwise in writing, you must not put payment-card numbers, passwords for other services, government identification numbers, or health information that is regulated by law into the Service.
6. What you may not do
You may not use the Service to:
- break the law; infringe intellectual property, privacy, publicity or other rights; or publish content you do not have permission to use;
- publish content that is sexually explicit, hateful, harassing, threatening, deceptive or invasive of privacy;
- track, surveil or locate people without their knowledge, or publish someone's home address or other personal information to expose or harass them;
- plan, promote or facilitate violence or other harm, or map targets for it;
- phish, defraud, distribute malware, send spam, or impersonate a person or organisation;
- access data that is not yours, test or bypass our security, credit metering or usage limits, interfere with the Service, or use it in a way that puts the Service or other people at risk; or
- resell access, scrape the Service, use it to build a competing product, reverse engineer it, or automate access except through an interface we provide for that purpose.
We decide whether content or conduct breaks these rules.
7. Review and enforcement
We may review prompts, maps and activity, by automated means or by people, to operate and secure the Service and enforce these terms. We have no obligation to monitor anything, and we are not responsible for Your Content or for failing to find or remove it.
If we believe content or conduct breaks these terms or the law, or creates risk for anyone, we may, with or without notice: block a request; make a map private; remove, disable or delete content; suspend or restrict a feature or an account; preserve evidence; and report conduct to the authorities. We may treat repeated or serious breaches as grounds to close an account. To report content or ask us to reconsider a decision, email support@mightymaps.app.
8. Copyright and other complaints
If you believe a public map infringes your copyright or other rights, email support@mightymaps.app with: your name and contact details; the work or right concerned; the link to the map; why you believe it infringes; and a statement that the information is accurate and that you are the owner or authorised to act for the owner. We may forward a notice to the map's owner, remove or disable the material, and close the accounts of repeat infringers. An owner who believes material was removed by mistake may reply with the same details and an explanation, and we may restore it.
9. Credits and payment
MightyMaps has no subscription and does not charge you on a recurring basis. New accounts receive the free credits shown on the pricing page (currently 50), and you can buy more in the packs and at the prices shown on our pricing page and at checkout, which we may change for future purchases at any time. Taxes may be added. Our payment processor, Stripe, sells credit packs as merchant of record and handles the transaction and applicable tax.
Credits are a unit for using the Service's paid features, such as the AI assistant and address lookups. They are not money, have no cash value, and cannot be sold or transferred. Credits do not expire while your account is open. Viewing, publishing and sharing a map do not use credits. Looking up addresses to place them on a map does, and so does every address search a visitor makes on a store locator you publish, which is charged to your account at the rate on the pricing page. When your balance runs out, you cannot make further AI requests or address lookups until you buy more, and a locator's address search falls back to searching the map's own list; that does not by itself take down your maps.
Except where the law requires otherwise, payments are non-refundable, including for credits used or unused. If something has gone wrong with a purchase, contact us; any refund we choose to give is at our discretion and does not entitle you to another. If a payment is disputed or reversed, we may suspend the account and remove the credits that were granted for it.
10. Availability and changes to the Service
We may change, add or remove features, limits, models and providers, and may suspend or discontinue any part of the Service or the Service as a whole, at any time. We do not promise any particular availability, response time or recovery, and public maps may be unreachable at times. Features we describe as beta, preview or experimental are provided as they are and may change or end without notice.
Online services and AI systems fail. Content may be lost, corrupted or displayed incorrectly. You are responsible for keeping your own copies of anything that matters to you.
11. Third-party services
The Service relies on third parties, such as hosting, AI, payment, email, sign-in, map data, map tile and routing providers. We are not responsible for third-party services, their availability, their accuracy, their terms or what they do with information. Your use of a third-party service, including signing in with one, is between you and that provider. Addresses are located with Amazon Location Service, whose data sources are listed on Amazon's data attribution page.
12. Our intellectual property
We and our licensors own the Service, including its software, design, map styles, interface, documentation and branding. These terms give you only the right to use the Service as they allow.
13. Suspension, termination and deletion
You may stop using the Service at any time. You can delete a map from the dashboard, and ask us to close your account by emailing support@mightymaps.app.
We may suspend or close your account at any time and for any reason, including a breach of these terms, risk to the Service or to others, a disputed payment, a legal requirement, or a long period without use. Where it is reasonable, we will give notice first.
When a map or account is deleted or closed, its content may be permanently deleted and may not be recoverable, public maps stop being served, and any credits on the account are forfeited. Copies may remain for a time in backups and records as the Privacy Policy describes. Every clause that by its nature should survive the end of this agreement survives it, including those on content licences, payment, disclaimers, liability, indemnity and disputes.
14. Disclaimers
To the fullest extent permitted by law, the Service, its output and everything provided through it are provided "as is" and "as available", with all faults. We disclaim every warranty and condition, express or implied, including those of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment. We do not promise that the Service will be uninterrupted, secure, error-free or free of harmful components, that content will be preserved, or that output will be accurate, lawful or suitable for your purpose. Your use of the Service is at your own risk.
15. Limits on liability
To the fullest extent permitted by law, neither we nor our suppliers or service providers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, for any loss of profit, revenue, business, opportunity, goodwill, data or content, or for any loss arising from reliance on a map, however caused and even if we were told it was possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Service or these terms is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Any claim must be brought within one year after it arose, or it is permanently barred.
These limits apply whatever the legal theory, including contract, tort, negligence and statute. They do not limit liability that cannot be limited by law. Some places do not allow certain exclusions, so some of this section may not apply to you.
16. Your responsibility to us
You will defend, indemnify and hold harmless MightyMaps and its owners, contractors and service providers against all claims, losses, damages, penalties and costs, including reasonable legal fees, arising out of Your Content, your public maps and anyone's reliance on them, your use of the Service, actions taken under your account, your breach of these terms, or your violation of the law or of anyone's rights. We may take control of the defence of a claim at your cost, and you will cooperate with us.
17. Disputes
These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Saskatchewan have exclusive jurisdiction over any dispute, except where the law of the place you live gives you a right to bring a claim there that cannot be waived.
Before starting a claim, you agree to email us a description of it and to try for 30 days to resolve it with us informally. To the extent permitted by law, claims may be brought only individually and not as a plaintiff or class member in a class, collective or representative proceeding.
18. Changes to these terms
We may change these terms by posting a new version on this page. If a change materially reduces your rights or increases your obligations, we will also give notice by email or through the Service before it takes effect, unless a legal or security reason requires it sooner. Continuing to use the Service after a change takes effect means you accept it. If you do not, you must stop using the Service.
19. General
We are not responsible for any failure or delay caused by events beyond our reasonable control, including failures of networks, hosting, AI or other providers, attacks, government action and natural events. If any part of these terms is found unenforceable, it will be enforced to the fullest extent possible and the rest remains in effect. Not enforcing a term is not a waiver of it. These terms, the Privacy Policy and the pricing page are the entire agreement between us about the Service and replace any earlier ones, unless we sign a separate written agreement with you. You may not assign or transfer this agreement without our written consent; we may assign it, including as part of a merger, reorganisation or sale. Nothing in these terms creates a partnership, agency or employment relationship, or gives rights to anyone else. If these terms are translated, the English version governs.

Questions, legal notices, content reports and complaints go to support@mightymaps.app. We send notices to the email address on your account, and they are received when sent, so keep it current.
